Data Disclosures

Generic Disclosures*

Customer shall not resell, copy, divulge, disseminate, transfer or distribute any data provided by any market data vendor set forth below, except for insubstantial portions on a non-continuous and non-systematic basis, and/or use such data to create any derived index. Customer shall not in any way alter, modify, reverse engineer, translate, decompile, disassemble, combine, convert or use any data provided by any market data vendor to calculate or create custom, blended or other derived data or derivative works except as expressly permitted under its contractual arrangements with Confluence or one of its affiliates.

Customer may not use any data provided by a market data vendor to create any financial products or services, develop securities, or use as components of benchmarks or financial instruments or products, whether publicly or privately used.

Customer acknowledges and agrees that the data provided by any market data vendor is owned by and proprietary to such market data vendor.

The market data vendors shall have no responsibility for, and disclaim all liability arising from, any errors, omissions, delays, or interruptions in the data provided by such market data vendor, whether such liability is direct or indirect.

*The above terms and conditions apply to all market data vendors and are in addition to, and not in substitution of, any further specific disclosures that may apply in respect of such market data vendor in connection with any of the products or services set forth below.
